The Office of Public Prosecutions (“OPP”) or the Australian Federal Police (“AFP”) will seek to restrain and have forfeited/confiscated property, if they believe the property is proceeds of a crime. Where property has been been restrained there are critical time periods in which applications for exclusion and/or compensation must be made. If applications are not made within the specific time periods, then restrained property can be permanently confiscated.
Anyone who has an interest in property that has been restrained should consider making an application for exclusion and/or compensation. We can provide you with advice as to the critical time periods in which applications must be made, as well as advice as to whether you should make an application.
